CONDITIONS OF CONTRACT AND WAIVER OF LIABILITY

This Master User Agreement constitutes a binding contract between you, the User, and One Blue Sustainability Private Limited with regard the use various services are provided by One Blue Sustainability Private Limited.

1.1 The tourism services under this agreement shall rendered by One Blue Sustainability Private Limited, a firm duly constituted as Private Limited Company and having registered office at CTE233, The Crest, Golf Course Road, Gurgaon 122002, Haryana India (hereinafter referred to as “Amakarro”).

1.2 Amakarro shall provide you (“User”) travel-related information, pricing of partner destinations, trip packages, and itineraries across cities and rural areas throughout India (“Service”). This Service may be availed by the User in India at any time during the year as is offered by various third-party vendors like homestays, partners etc. (“Service Providers”).

1.3 This Master User Agreement (“Agreement”) is applicable to Amakarro. In addition, this Agreement and depending on Services opted for User, the User shall be required to read and accept the relevant terms and conditions of service (“TOS”) for each such Service, which may be updated or modified by Amakarro from time to time. Such TOS shall be deemed to be a part this Agreement and in event of conflict between such TOS and this Agreement, the terms of Agreement shall prevail.

1.4 Amakarro Services are offered to User conditioned on acceptance without modification of all the terms, conditions and notices contained in Agreement and the TOS, as may be posted on the Website from time to time. For the removal of doubts, it is clarified that availing of Services by User constitutes an acknowledgement and acceptance by User this Agreement and the TOS. If User does not agree with part of such terms, conditions and notices, the User must not avail India Amakarro’s Services.

1.5 Additionally, the Service Provider itself may provide terms and guidelines that govern features, offers or the operating rules and policies applicable to each Service (for example, homestay reservations, itineraries, trip packages, experiences,etc.). The User shall be responsible for ensuring compliance with the terms and guidelines or operating rules and policies of Service Provider with whom the User elects to deal, including terms and conditions set forth in Service Providers’ fare rules, contract of carriage or house rules.

1.6 Amakarro, at sole discretion reserves the right not to accept any order placed by user through website without assigning any reason thereof. Any contract to provide any service by Amakarro is not complete until full money towards the service is received from user and accepted by Amakarro.

3. Payment
The prices quoted are for payment by bank transfer, online transfer (credit cards/debit cards) , or cheque. The total price is payable to Amakarro, 10 days prior to departure. Failure to pay by that date entitles Amakarro to cancel your reservations without notice. Prices are quoted in Indian Rupees. All prices and details quoted on Amakarro website are to the best of knowledge and constantly updated from time to time. Prices may be changed at discretion of the partner destination or other service providers involved without prior notice, and Amakarro will not be held liable for such changes. In case of a conflict, the prices charged by the partner destinations and service providers involved will be final.

4. Cancellations
If it becomes necessary to cancel your booking, you must notify Amakarro immediately in writing/email. Once we receive your notice, cancellation will take effect. Please note that the following charges will apply on cancellation:

• if cancellation takes place more than 30 days prior to departure, your full deposit will be returned.
• if cancellation takes place between 30 days & 15 days prior to departure, 50% of the booking price will be forfeited; and
• if cancellation takes place less than 15 days prior to departure, 100% of the booking price will be forfeited.

If the tour/itinerary price is quoted as a package, no partial refunds or credit will be given for services not used. Please note that the above quoted amounts may change without notice. We also recommend that you obtain travel insurance upon booking.

*If there is a conflict between this cancellation policy & the service provider’s (homestay, farm stay, transport company etc) cancellation policy, the latter will prevail.

5. Health and Fitness Requirements
Participants must be in good health and reasonable physical condition. It is vital that participants with medical problems make them known to us well before departure. All medical expenses will the responsibility of the participant.

6. Delay, Cancellation or Change of Itinerary

7. Insurance
Personal travel insurance is not included in the tour price. We strongly recommend that you take out travel insurance including cancellation insurance upon booking. Amakarro may require that a policy is held prior to departure. Amakarro will accept no liability for any damage, losses and expenses suffered by any client as a result of sickness, quarantine, weather conditions, war, strikes, riots, or other cause outside our control.

8. Route Changes/Postponement or Delay
Amakarro will take every care to ensure that itineraries/trips are followed to the letter but circumstances beyond control may necessitate changes. In case of a change in routes and properties, Amakarro will accept no liability but decide for substitution of equal.

Amakarro may for any reason change the date of departure or conclusion of the tour, or it is possible that a route change, postponement, or delay (either in relation to departure or to the duration of the trip) may become necessary due to inclement weather, snow and ice conditions, political restrictions, or any other cause. In the event of a change, postponement or delay, participants have no right to refund of the tour price (in whole or in part) or other compensation for any injury, loss, or damage.

9. Package Prices
Package prices are based on destination costs, transport charges and exchange rates. Amakarro tries its utmost not to increase tour prices (in full or part), however sometimes increases are outside its control. We reserve the right to amend tour prices (or any part) without notice at any time before and including the departure date. Amendments may be necessitated for many reasons including, but not limited to, exchange rate fluctuations, increase in destination costs, transport charges, meals etc. Any increase in tour prices must be paid prior to the departure date.

10. Exclusions from Tour Price

• The following items are excluded from tour price:
• visa, passport, travel insurance and vaccination charges;
• departure, airport, and airline taxes; extra meals not included in the itinerary;
• laundry, postage, telephone expenses, personal clothing, medical expenses, personal travel insurance and items of personal nature;
• emergency evacuation charges; and
• tips and excess baggage charges.

11. WAIVER OF LIABILITY
I “the user” on availing Amakarro services, waive any and all claims I and/or my family or any person interested in me may now and the future have against, and release from all liability and agree not to sue Amakarro and it management, officers, employees, guides, agents or representatives (collectively its staff) including but not limited to persons hired/engaged by Amakarro for personal injury, death, property damage, or loss sustained by me as result of my participation in trip/stay with them, due to cause whatsoever, including without any limitation, negligence on part of Amakarro and it staff/service providers or otherwise arising out of or in connection with any accommodation, transportation or other services provided by Amakarro, or resulting directly or indirectly from acts of God, or breakdown of machinery or equipment used during the tour, whether provided by Amakarro or not. I am aware that trip, in addition to usual dangers and risks inherent, has certain additional dangers and risks, some of include: physical exertion which may not be prepared; weather extremes subject to sudden and unexpected change; remoteness from normal medical services; evacuation difficulties if disabled.
I understand that I should be in perfect health for undertaking this journey and have consulted my physician before coming on this trip. I understand that Amakarro will not take responsibility for reimbursements in event that I’m unable to complete the trip due to sickness and/or other personal reasons.
I accept the inherent risks of proposed trip and the possibility of personal injury, death or property damage or loss resulting there from. I agree that if I suffer injury or illness, Amakarro, can, at my cost, arrange medical treatment and emergency evacuation service, as they deem essential for my safety. In entering into this Agreement, I am not relying on any oral, written, or visual representations or statements by Amakarro or its staff or any other inducement or coercion to go on a trip, hence, only of my own free will. I confirm that I have read and understood the terms and conditions of contract and this Agreement and agree that this Agreement will binding upon my heirs, next of kin, executors, administrators, and successors.

12. Right of Removal
Amakarro reserves the right to withdraw tour membership from anyone whose behaviour is deemed likely to affect the smooth operation of tour or adversely affect the enjoyment and personal safety of other participants. Amakarro shall be under no liability to any person.

13. Applicable law
This Agreement will be governed by the laws of India, without reference to its choice of law rules and shall be subject to the exclusive jurisdiction of the courts at Gurgaon, India.
